A financial agreement is a legally binding document that sets out the parameters between two parties in relation to financial matters. Often referred to as ‘prenups’, this document is used by parties who wish to protect their individual assets. A financial agreement can also outline the arrangement for property settlement and/or spousal maintenance in the event that they separate, or if they have already separated.

A financial agreement can be entered into:

• Prior to a marriage or de facto relationship
• During a marriage or de facto relationship
• After the breakdown of a marriage or de facto relationship
